Welcome to fynding (the "App"), a mobile application operated by Finding Your Information Network Technologies Corporation, a company duly organized and existing under the laws of the Republic of the Philippines ("Company", "we", "us", or "our").

By downloading, accessing, or using the fynding mobile application, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the App.

Definitions

User – any individual who accesses or uses the App.
Service – features, functionalities, and content provided through the App.
Content – text, images, listings, data, and other materials available on the App.

Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the App.

Account Registration

You may be required to create an account to access certain features.
You agree to provide accurate, complete, and updated information.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities conducted under your account.

Description of Services

fynding is a business media and community-based mobile application designed to serve MSMEs, entrepreneurs, and business-minded individuals. The App is divided into several Segments:

Emergency Contact Segment – provides access to emergency contact numbers for general reference only.
Business Directory Segment – allows businesses to create profiles and list business information.
Messaging and Notice Board Segment – enables users to communicate and post updates.
Referral Incentive Segment – allows subscribers to refer users and earn incentives.

Subscription, Incentives, and Payments

Certain features may require a paid subscription.
All payments are non-refundable, except as required by applicable Philippine law.
Failure to pay applicable fees may result in restricted access, suspension, or termination.

Referral Incentives

Referral incentives are promotional in nature.
Incentives may be subject to eligibility requirements, caps, and anti-fraud checks.
The Company reserves the right to modify or terminate the referral program at any time.

Subscriber and Referrer Agreement

I UNDERSTAND AND AGREE TO THE FOLLOWING AS A Subscriber and Referrer OF Finding Your Information Network Technologies Corporation ("fynding") ["Company"]:

That I am 18 years old (or older) and deciding with my own free will as I have personally attended and received my orientation at a Company approved Subscription Referrer Orientation (SRO) prior to referring others for subscription.
That my subscription is accompanied by cash in the right amount including taxes, if any, and paid to Finding Your Information Network Technologies Corporation.
That my Referrership with the Company is a lifetime commitment and will only be forfeited if I have done any grievous acts detrimental to the company and its reputation and good standing in the community.
That I have read and understood the Company's policies and will operate my business according to these Policies, Procedures, and Marketing Program. I acknowledge that the Company may after reasonable notice, change, amend or modify this agreement.
That I am not an employee, partner, joint venturer, agent or legal representative but an independent referrer in the business of inviting others for subscription in "fynding," hence I will be responsible for compliance with the Republic of the Philippines local statutes and regulations including but not limited to those relating to licensing and taxation.
That the Company will credit my effort as a Referrer as written in the Marketing Program. There is no guarantee of any earnings or exclusive territories in the Program.
That I will represent the Company and its marketing program properly and will make no statements, claims or warrantees which are not in the program.
That this agreement and my subscription is personal in nature and cannot be assigned or transferred except in the event of my death.
That this application constitutes a binding agreement between myself and the Company when this application is received and approved by the Company's Head Office, governed by the laws of the Republic of the Philippines.

User Obligations

You agree not to:

Use the App for unlawful, deceptive, or fraudulent purposes;
Misrepresent your identity, business, or authority;
Post false, misleading, defamatory, or infringing content;
Engage in spam, pyramid schemes, or misleading referral practices;
Violate any applicable Philippine laws or regulations.

Intellectual Property

All intellectual property rights in the App are owned by or licensed to the Company. Unauthorized use is strictly prohibited.

Emergency Disclaimers

The Emergency Contact Segment is provided for reference and convenience only.
The Company does not operate, manage, or control emergency services.
In critical situations, contact official emergency hotlines directly.
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any loss, injury, or damage arising from use of the App or reliance on its content.

Governing Law

These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be submitted to the proper courts of the Philippines.

Amendments

The Company reserves the right to update or modify these Terms at any time. Continued use of the App after changes constitutes acceptance.

By using the fynding App, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
